Niels van Steijn practices general civil- and administrative law and has experience in litigation before the Dutch civil and administrative courts (including the Dutch Supreme Court). Furthermore, he has experience in drafting several types of agreements.
Apart from his knowledge of general civil- and administrative law, he has specific knowledge of pharmaceutical-, healthcare- and intellectual property law. For example, he has advised or represented clients in the following fields: reimbursement, classification, advertising and parallel import of pharmaceuticals and medical devices, regulatory matters and permits, clinical trials, publications, government grants, tariffs and prices, official recognition of EU and non-EU education/ qualifications (BIG-register), relations between the pharmaceutical industry and health professionals and unfair competition. In addition, he has drafted, reviewed and negotiated various types of sector related agreements, such as service-, license- , research- , technology transfer- , material transfer-, confidentiality and clinical trial agreements as well as general terms and conditions.
Examples of pharmaceutical cases handled by
§ Representing a pharmacist against a group of general practitioners who were pioneering in the joint exploitation of a pharmacy. The Court of Appeal in s-Hertogenbosch declared this construction unlawful (www.rechtspraak.nl, LJN: AW0703);
§ Providing legal assistance to pharmacists in support of their successful lobby activities during the parliamentary treatment of the new Pharmaceuticals Act;
§ Representing a group of approximately 150 Dutch pharmacists against a tariff decision of the Dutch tariffs authority lowering the reimbursement tariffs of Dutch pharmacists; the case was successfully completed when the tariff decision was suspended in summary proceedings and finally cancelled in proceedings on the merits (www.rechtspraak.nl, LJN: AO0546);
§ Representing a pharmaceutical company and obtaining an injunction against a competitor in a pharmaceutical advertising case before the Dutch Code Committee (?Codecommissie van de Stichting CGR?);
