Civil Service Law and Education Law
Although the civil service law is similar to the labour law, it is a separate jurisdiction. The civil service law has its own way of litigating and advising. Thus civil servant cases are first and foremost dealt with by a complaints commission before they go to court, sector administrative law. The magistrate/lower court judge does not pronounce sentence in civil servant cases. In many cases the “kantonrechtersformule” (= the formula the Lower Court Judge uses to establish the amount of severance compensation in case of a termination of an employment agreement) does not apply and a supplementary agreements are made.
The legal status of employees in the various educational institutions is determined by special regulations. For example, a supplementary agreement may be applicable to the employee.
